General Terms and Conditions for the purchase of goods on Edizioni Antilia sas online Shop

1) Scope

The following contractual terms apply to all offers, orders and deliveries of the products available on Edizioni Antilia sas online Shop. Any other rule differing from these contractual terms is not acknowledged, unless it is an individual agreement or there is the relevant written confirmation.
By placing an order, the Customer accepts unconditionally these General Terms and Conditions.

2) Orders and sales

When an order is placed, the contract between the Customer and Edizioni Antilia sas (hereinafter referred to as “Edizioni Antilia”) takes effect.
By pressing the Confirm button, the order is bindingly submitted.
The automatic order confirmation generated by the ordering procedure is neither a delivery confirmation nor an order confirmation by Edizioni Antilia.
The purchase contract takes place only with the sending of the goods by Edizioni Antilia, or with a specific delivery confirmation by Edizioni Antilia.
If the goods are not available, Edizioni Antilia is authorized to terminate the purchase contract, provided that one took place. In this case, the customer will be notified, and any payments made will be promptly reimbursed.
In any case, Edizioni Antilia is not obliged to accept the order and to deliver it.
The minimum order accepted by Edizioni Antilia is one volume of a publication, regardless of the cover price.

3) Customers and prices

Sales are aimed to professional operators (with VAT number) and to private persons, in any case VAT is paid by the publisher (as provided for by Art. 74 of the Italian Civil Procedure Code).
Prices are those in force at the time of the order, except for clerical errors and in case of out of stock.
The previous price lists are to be considered null for the purpose of the order to be submitted online.
For the sale both to professional operators and to private persons, the prices specified in our offers, and in general in the online Shop, are VAT include (paid by the publisher).
Also ancillary costs (e.g. transport for delivery) are specified VAT included.
No reductions can be granted on the prices specified on the online Shop. For special orders please contact the publisher by phone (+39 328 0773269) or by email posta@edizioniantilia.it.

4) Payments

5) Deliveries, conditions and delivery costs

– The sale and deliveries are made to the delivery address, without limitation of the recipient’s country.
– Shipping and delivery are made at Edizioni Antilia risk.
– Edizioni Antilia adopts all organizational care and caution to ensure that the delivery of the ordered goods takes place within 8 working days from the time of the order or from the collection date (in case of payment by bank transfer). It should be noted that the above specified delivery times are merely indicative, and may be subject to delays in all cases of force majeure or of unforeseeable circumstances. Delivery times may be longer in case of orders placed on weekends or holidays, of deliveries to islands or peripheral areas, in case of strikes.
– The possibility of claims for damages for delayed deliveries is excluded a priori, unless it’s proven Edizioni Antilia’s intention or severe negligence. Normally the courier delivers the goods on weekdays.
– The Customer, or his/her representative, must accept the delivery upon receipt by signing the delivery receipt.
In case of failure to deliver the goods due to the absence of the Customer, the courier will leave a notice and try to deliver the goods in the following days. Should the delivery fail a second time, the goods will remain in stock at the courier: please contact us if the shipping times seem longer than expected. In most cases the goods will remain at the courier stock for collection for a week. After this deadline the goods will be returned to Edizioni Antilia.
– In this case we will contact you to agree on how to proceed.
– The Customer and/or the person appointed by the same to collect the goods is required to check, at the time of delivery and in the presence of the carrier, the integrity of the delivered packages and the relevant number, reporting any discrepancies and/or external damages to the carrier at the time of delivery (specifying on the delivery document the status of the packages), and subsequently to our Customer Service within eight (8) days from the receipt of the goods.
– Delivery in Italy, San Marino and Vatican City is free.
– Delivery to European countries (EU, Monaco, Liechtenstein, Switzerland, Andorra) costs € 15.00.
– Delivery in all non-European countries (as specified above) costs € 30.00.
– If the goods are not available, Edizioni Antilia is authorized to terminate the purchase contract, provided that one took place. In this case, the customer will be notified, and any payments made will be promptly reimbursed.

6) Guarantee

Edizioni Antilia takes great care in packing the volumes, which are all new from the printing house; however if the delivered goods show visible defects, or differ from what has been ordered, the Customer can request, at his/her choice, either the replacement or the refund of the sum paid for the rejected goods after direct agreement with the Customer Service.

7) Right of return and right of withdrawal

The purchase is absolutely risk-free as the right to return the goods is guaranteed, without the need to specify the reason, within 14 days from the receipt of the goods, and after the notice of revocation and withdrawal to Edizioni Antilia, which must be done exclusively in writing.
To comply with the withdrawal deadlines, simply send promptly the withdrawal request, by registered letter with return receipt, by e-mail or certified e-mail, within 14 days and promptly return the goods within 7 days from the date of the notification sent to Edizioni Antilia.

The shipping and packaging costs are borne by the customer, who must use the original packaging.
Used products are excluded from the right of return.
In the event of delivery anomalies, or if the package is externally damaged, it must be specified in writing on the courier’s delivery document, at the time of delivery, with the words “I accept the delivery with proviso”, specifying the type of damages or anomalies found. Then it is necessary to promptly contact our Customer Service at the above specified addresses.
In the event of a return, Edizioni Antilia undertakes to refund the amount due as soon as the returned goods have arrived at the destination warehouse and have been checked.
In the event of a refund, the customer is aware that it will only be done by bank transfer.
In the event of force majeure, or unforeseeable circumstances, Edizioni Antilia will not be responsible for the delay or failed delivery, and will have the right to terminate all or part of the contract, to suspend it, or to postpone its execution.
Our conditions of sale, delivery and payment are considered accepted at the time of the order.
Except as provided in the previous points “Right of return” and “Guarantee”, is excluded any compensation for any damage suffered by the customer or third parties, and any other obligation other than those explicitly provided herein.
In no case Edizioni Antilia will be responsible for any indirect damage (including, but not limited to, damage due to loss of earnings, business interruption, loss of information, or other economic losses) that may arise to the Customer from the execution of the contractual obligations.

 

8) Ownership

Until the full payment, the goods remain property of Edizioni Antilia.

9) Legislation, jurisdiction and legal notes

This contract is governed by Italian law. In case of dispute arising from the same contract, the applicable law is the Italian Law, and the competent court is the Court of Treviso (Italy). In case of dispute over the interpretation, the text in Italian language will prevail.

10) Recording and protection of personal data

We respect the privacy of our customers, and their personal data are processed according to the laws on the protection of privacy (GDPR, EU regulation No. 2016/679).
By placing an order, you acknowledge and agree that your personal data may be used by Edizioni Antilia for the purposes set out below.
The first time personal data such as surname, name, address, and email, are collected for commercial reasons. This information is used exclusively to create anonymous statistics on the use of our online offer. Details relevant to customer orders can be processed by frequency of purchase and by volume of sales, in order to allow us to better adapt our offer to the customers needs.
The customer’s personal data are not disclosed to third parties, except for any legal obligation and for the disclosure necessary to carry out the order. It is guaranteed that, without customer authorization, no personal data will be used by third parties except as specifically requested by the customer’s order, as provided in our Privacy Policy.
